Historical Society Expanding

The nonprofit group dedicated to preserving Georgia's history is moving a big step closer to expanding its Savannah headquarters for the first time in 40 years.

The Georgia Historical Society has received a $500,000 grant from the Robert W. Woodruff Foundation that will go toward plans to renovate and move into a three-story antebellum mansion next to the society's library and archives in downtown Savannah.

The renovated space will be used for executive offices and a new education center while retaining the character of the 1856 home.

Historical society officials say more money is needed to fund the project, but the grant brings it significantly closer.

The Georgia Historical Society has been collecting, preserving and sharing documents and records chronicling the state's history for nearly 175 years.

Tight times may influence how we perceive others

ScienceDaily (Nov. 28, 2012) ? From the playground to the office, a key aspect of our social lives involves figuring out who "belongs" and who doesn't. Our biases lead us -- whether we're aware of it or not -- to favor people who belong to our own social group. Scientists theorize that these prevalent in-group biases may give us a competitive advantage against others, especially when important resources are limited.

Psychological scientist Christopher Rodeheffer and his colleagues at Texas Christian University wanted to examine whether resource scarcity might actually lead us to change our definition of who belongs to our social group. Their new research is published in Psychological Science, a journal of the Association for Psychological Science.

One way of defining an in-group is according to outward appearance. Rodeheffer and colleagues hypothesized that people exposed to situations of scarcity would narrow their definition of who "belongs" and would be less likely to categorize a racially ambiguous face as part of their racial in-group.

In their first experiment, the researchers asked 71 White college students to look at captioned pictures that depicted instances in which resources were scarce (e.g., a picture of an empty office with captions about a shortage of good jobs) or abundant (e.g., a picture of a thriving office with captions about there being plenty of good jobs).

Rodeheffer and his colleagues created a series of biracial faces by averaging one White and one Black face using a face-averaging software program. They asked the participants to look at the biracial faces and categorize each face as either Black or White.

The findings showed that students who had looked at pictures depicting scarce resources were more likely to categorize the faces as Black than students who had seen the pictures of abundant resources.

These results were confirmed in a second experiment that used a verbal priming procedure in which the students were primed to think about resource scarcity or abundance by completing analogy problems.

According to the researchers, these findings suggest that "times of economic hardship may limit the inclusiveness of people's racial in-groups."

Rodeheffer and his colleagues note that future studies should examine whether the effects of resource availability cues on racial categorization are observed for participants of other races to ensure that the results are applicable across racial groups.

Court rules Interior didn't violate judge's order

NEW ORLEANS (AP) ? The Obama administration didn't violate an order by a judge who struck down its temporary moratorium on deep water drilling after BP's 2010 oil spill in the Gulf of Mexico, a federal appeals court has ruled.

A three-judge panel from the 5th U.S. Circuit Court of Appeals on Tuesday reversed U.S. District Judge Martin Feldman's civil contempt finding against the Interior Department. The divided panel's majority opinion concludes Interior officials took steps to avoid the effect of an injunction issued by Feldman but didn't violate it.

In his February 2011 ruling, Feldman chided the department for its "dismissive conduct" after he overturned its decision to halt new permits for deep water projects and suspend drilling on 33 exploratory wells after the Deepwater Horizon rig explosion killed 11 workers and triggered the massive spill.

After Feldman overturned the government's moratorium in June 2010, the agency issued a second nearly identical suspension.

The 5th Circuit panel, however, said Feldman's injunction didn't explicitly prohibit a new moratorium, let alone one that was nearly identical to the first.

"A more broadly worded injunction that explicitly prohibited the end-run taken by Interior would have set up issues more clearly supportive of contempt," Judge Leslie Southwick wrote in the majority opinion.

The 5th Circuit threw out Feldman's award of roughly $530,000 in attorneys' fees and costs to offshore service companies that challenged the moratorium, including Hornbeck Offshore Services LLC.

Southwick said the Interior Department was carrying out a policy decision by President Barack Obama.

"The national importance of this case weakens, not strengthens, the propriety of the court's contempt finding," he wrote.

In a dissenting opinion, Judge Jennifer Walker Elrod said she believes Feldman didn't abuse his discretion in holding the Interior Department in contempt.

Walker said the majority opinion's remark that the "controversial policy decisions" at issue were "made at the highest levels of government" doesn't insulate those decisions from judicial review.

"The court's power to enforce its orders must remain intact, even in the midst of the most critical emergencies of the state," she wrote. "Simply put, the Judiciary may be the least dangerous branch, but it is not entirely toothless."

(AP) ? So you just won the $500 million Powerball jackpot, the second highest in lottery history. Now what?

Perhaps it's time for a tropical vacation or a new car. There are bills to pay, loans to settle, debts to square.

Past winners of mega-lottery drawings and financial planners have some more sound advice: Stick to a budget, invest wisely, learn to say no and be prepared to lose friends while riding an emotional roller-coaster of joy, anxiety, guilt and distrust.

"I had to adapt to this new life, "said Sandra Hayes, 52, a former child services social worker who split a $224 million Powerball jackpot with a dozen co-workers in 2006, collecting a lump sum she said was in excess of $6 million after taxes. "I had to endure the greed and the need that people have, trying to get you to release your money to them. That caused a lot of emotional pain. These are people who you've loved deep down, and they're turning into vampires trying to suck the life out of me."

The single mother kept her job with the state of Missouri for another month and immediately used her winnings to pay off an estimated $100,000 in student loans and a $70,000 mortgage. She spent a week in Hawaii and bought a new Lexus, but six years later still shops at discount stores and lives on a fixed income ? albeit, at a higher monthly allowance than when she brought home paychecks of less than $500 a week.

"I know a lot of people who won the lottery and are broke today," she said. "If you're not disciplined, you will go broke. I don't care how much money you have."

Lottery agencies are keen to show off beaming prize-winners hugging oversize checks at celebratory news conferences, but the tales of big lottery winners who wind up in financial ruin, despair or both are increasingly common.

There's the two-time New Jersey lottery winner who squandered her $5.4 million fortune. A West Virginia man who won $315 million a decade ago on Christmas later said the windfall was to blame for his granddaughter's fatal drug overdose, his divorce, hundreds of lawsuits and an absence of true friends.

The National Endowment for Financial Education cautions those who receive a financial windfall ? whether from lottery winnings, divorce settlements, cashed-out stock options or family inheritances ? to plan for their psychological needs as well as their financial strategies. The Denver-based nonprofit estimates that as many as 70 percent of people who land sudden windfalls lose that money within several years.

"Being able to manage your emotions before you do anything sudden is one of the biggest things," said endowment spokesman Paul Golden. "If you've never had the comfort of financial security before, if you were really eking out a living from paycheck to paycheck, if you've never managed money before, it can be really confusing. There's this false belief that no matter what you do, you're never going to worry about money again."

David Gehle, who spent 20 years at a Nebraska meatpacking plant before he and seven ConAgra Foods co-workers won a $365 million Powerball jackpot in 2006, used some of his winnings to visit Australia, New Guinea and Vietnam. He left ConAgra three weeks after he won, and now spends his time woodworking and playing racquetball, tennis and golf.

But most of his winnings are invested, and the 59-year-old still lives in his native Lincoln. He waited for several years before buying a $450,000 home in a tidy neighborhood on the southern edge of town.

"My roots are in Nebraska, and I'm not all that much different now than I was before," Gehle said. "I'm pretty normal. I never was the kind of guy who went for big, expensive cars or anything like that. I just want something that runs."

In the first year after he won, Michael Terpstra would awaken many nights in a panic. Had he slept in? Was he late to work the night shift?

"At times I'd wake up and this would all seem like a dream," the 54-year-old said. "I'd have to walk around the house and tell myself, I did win. I'm not working anymore, and I do live here. I didn't get drunk, break into someone's house and go to sleep. This is where I'm supposed to be."

His new home is a roomy, two-story house in south Lincoln with a big-screen television and paintings of Jesus on the walls. He no longer uses alarm clocks and spends his days taking his 92-pound black lab, Rocco, on walks.

He was terrified when he first won, convinced that he would lose all of the money and have to return to work. So he lives carefully off the interest from conservative investments, with help from accountants and lawyers. He bought the new house and a truck, but struggles to name any extravagant purchases.

"I can't buy a super yacht. I can't buy a Gulfstream," he said. "Then again, I don't think I'd use either one, so why would I buy one?"

That said, some mega-winners still can't resist the lure of big jackpots, at least not the two-buck chances. On Tuesday, former ConAgra worker Dung Tran, a Vietnamese immigrant, walked into the same Lincoln U-Stop where he purchased the winning ticket six years ago and bought 22 more from the very employee who sold him the first prize-winner, said cashier Janice Mitzner.

"We joked about it," she said. "I told him, 'Wouldn't it be something if you won again?'"

Hayes is also hoping to strike rich again ? she bought 10 tickets at a Dirt Cheap liquor store on her way home Tuesday while speaking with an Associated Press reporter. Unlike many big winners, she has kept a visible public profile instead of going underground, appearing on a 2007 reality TV show ("Million Dollar Christmas"), writing an online Life After the Lottery blog and self-publishing a short book, "How Winning the Lottery Changed My Life."

"We have this drawing tomorrow, and if somebody wins, God bless them," she said. "They're going to need those blessings."

AHS, Silicon Energy turn Larson stadium 'green'

ARLINGTON ? As part of the Snohomish County PUD's voluntary "Planet Power" green energy program, AHS has installed solar panels purchased from Silicon Energy on the John C. Larson stadium.

The Arlington School District applied for a grant, available through the PUD, to fund the majority of the cost for installation, which was performed by Arlington Electric.

"Not only will this project reduce our electrical consumption, but it will also be a valuable teaching aid for our students," said Sid Logan, executive director of operations for the Arlington School District, who touted the lower impact on the environment and the cost savings of the solar panels, in addition to the educational potential of the data they will yield.

Solar photovoltaic modules, such as those manufactured by Silicon Energy in Marysville, are a viable energy source in Washington despite the state's number of rainy and cloudy days, since the temperate climate actually helps solar perform better by keeping such systems cooler.

An eight-kilowatt solar array was added to the top of the stadium, with its last four modules installed on Monday, Nov. 5. Since the solar panels produce DC power, inverters will also be installed to convert the electricity to AC.

The energy generated by this system will be used on site, at the stadium or at the school, wherever electricity is needed, to reduce the energy costs for the district and taxpayers. The solar energy will be blended with the school's regular electrical source of power, since there are times, such as at night, when solar power isn't being produced.

The project includes the creation of an interactive Internet webpage to share and monitor the system's performance with students, families and the public. The PUD's goal is to choose high profile projects so that communities can learn more about renewables and solar photovoltaics.

European Parliament Opposed To ITU Takeover Of The Web ...

The fate of the free Internet will be decided at a private meeting in Dubai next month. UN member nations will argue for or against a plan that would give up control of the Internet to the ITU. Some within the US government have already voiced their opposition, and now the EU is joining them.

Wired UK reports that the European Parliament has issued a resolution against a potential takeover of the Web by the ITU. The resolution contains many of the same arguments that people like Vint Cerf have said about the proposed UN regulation. There?s a lot of good stuff here, and other nations would be wise to wied these arguments during negotiations next month:

1. Calls on the Council and the Commission to ensure that any changes to the International Telecommunication Regulations are compatible with the EU acquis and further the Union?s objective of, and interest in, advancing the internet as a truly public place, where human rights and fundamental freedoms, particularly freedom of expression and assembly, are respected and the observance of free market principles, net neutrality and entrepreneurship are ensured;

2. Regrets the lack of transparency and inclusiveness surrounding the negotiations for WCIT?12, given that the outcomes of this meeting could substantially affect the public interest;

3. Believes that the ITU, or any other single, centralised international institution, is not the appropriate body to assert regulatory authority over either internet governance or internet traffic flows;

4. Stresses that some of the ITR reform proposals would negatively impact the internet, its architecture, operations, content and security, business relations and governance, as well as the free flow of information online;

5. Believes that, as a consequence of some of the proposals presented, the ITU itself could become the ruling power over aspects of the internet, which could end the present bottom-up, multi-stakeholder model; expresses concern that, if adopted, these proposals may seriously affect the development of, and access to, online services for end users, as well as the digital economy as a whole; believes that internet governance and related regulatory issues should continue to be defined at a comprehensive and multi-stakeholder level;

6. Is concerned that the ITU reform proposals include the establishment of new profit mechanisms that could seriously threaten the open and competitive nature of the internet, driving up prices, hampering innovation and limiting access; recalls that the internet should remain free and open;

7. Supports any proposals to maintain the current scope of the ITRs and the current mandate of the ITU; opposes any proposals that would extend the scope to areas such as the internet, including domain name space, IP address allocation, the routing of internet-based traffic and content-related issues;

8. Calls on the Member States to prevent any changes to the International Telecommunication Regulations which would be harmful to the openness of the internet, net neutrality, the end-to-end principle, universal service obligations, and the participatory governance entrusted to multiple actors such as governments, supranational institutions, non-governmental organisations, large and small businesses, the technological community and internet users and consumers at large;

9. Calls on the Council to coordinate the negotiation of the revision of the ITRs on behalf of the European Union, on the basis of inclusively gathered input from multiple stakeholders, through a strategy that primarily aims at ensuring and preserving the openness of the internet, and at protecting the rights and freedoms of internet users online;

10. Recalls the importance of safeguarding a robust best-effort internet, fostering innovation and freedom of expression, ensuring competition and avoiding a new digital divide;

11. Stresses that the ITRs should state that the ITU recommendations are non-binding documents which promote best practices

There?s a lot here, but the central fears of an ITU takeover are two-fold. For one, the proposed Internet tax system would greatly affect how companies do business around the world. A leaked document said that some nations are pushing for a global Internet tax. In effect, nations would have the power to tax companies like Google in return for being allowed to operate in those nations. You can already see the potential abuse this system would bring.

The other is far more serious, and one of the reasons why nations like Iran and China are pushing so hard for this. It would allow individual nations to control how the Internet operates in their country even more thus leading to even more censorship. Iran is already developing its own private Internet, but a change to the ITU would make that internationally endorsed.

Kansas appellate court upholds constitutionality of state law criminalizing sexual relations between teacher and student enrolled at the same school

State of Kansas v. Edwards, No. 106,435 (Kan. App. Ct. Nov. 2, 2012)

Abstract: The Kansas Court of Appeals has ruled that a state law making it a crime for a teacher to engage in sexual relations with a student enrolled at the school where the teacher is employed is constitutional. The appellate court concluded: ?Because the statute applied in this case implicitly recognizes the disparity of power inherent in the teacher/student relationship, we conclude that the right of privacy does not encompass the right of a high school teacher to have sex with students enrolled in the same school system.?

The appellate court rejected the teacher?s argument that two other state appellate courts had declined to find a teacher civilly liable for sexual relations with a student, thus rendering Kansas? criminal law unconstitutional. Instead, it found that the State had demonstrated that it ?has a legitimate interest in keeping the environment of those children required by law to attend school safe and free from sexual coercion from those in positions of authority or trust,? thus providing a rational basis for the law.

Facts/Issues: Charles Edwards was employed by Wichita Unified School District No. 259 as a choir teacher. A.C.A was enrolled as a student at the same school where Edwards was teaching. At the time she engaged in a consensual sexual relationship with Edwards, she was 18 years old, the age of majority, and was not married to him.

Edwards was charged criminally under?K.S.A. 21-3520(a)(8), which defines unlawful sexual relations as engaging in consensual sexual intercourse, lewd fondling or touching, or sodomy with a person who is not married to the offender if ?the offender is a teacher or a person in a position of authority and the person with whom the offender is engaging in [the prohibited conduct] is a student enrolled at the school where the offender is employed.?

The trial court found Edwards guilty of unlawful sexual relations in violation of the statute. Edwards appealed his conviction, arguing that the statute is unconstitutional because it infringes upon a privacy right,?i.e., the right to engage in private, consensual sexual conduct, protected by both the United States and Kansas Constitutions.

Ruling/Rationale: The Kansas Court of Appeals upheld Edwards? conviction, finding the statute at issue to be constitutional. The appellate court began its analysis by examining whether there is a constitutionally protected right of privacy. Based on U.S. Supreme Court precedent, it concluded that there is a court-recognized right to privacy, but cautioned ?that liberty must never be confused with license.?

The appellate court then examined the language of the statute in question, determining that ?it is clear that the intent of this statute is to prohibit sexual conduct of certain persons who have authority over other persons where the ability to freely consent is questionable.?

The appellate court?then looked at the?right at stake, i.e.,?whether teachers have a right to consensual, private sex with their students, to determine if it is a fundamental right. Based on its review of state and federal cases on the issue, the court agreed with the State and concluded that the ?teacher/student sexual relationship is not a relationship that warrants protection as a fundamental right.?

As a result, the court applied the rational basis test in reviewing the statute to see if the State has a legitimate interest. In addressing that question, the appellate court found that Kansas has such a legitimate interest in criminalizing sexual relations between teachers and students at the same school (regardless of the student?s age), because students are situated in a relationship (teacher-student) where ?consent?may not be easily refused.? Also, the statute ?does not infringe upon any sexual activity unrelated to the job of teachers and does not prevent teachers from having sexual relationships with adults who are not students.?

The appellate court rejected Edwards? reliance on Paschal v. State, 2012 WL 1034538 (Ark. Apr. 2012), in which the Arkansas Supreme Court determined that a state statute criminalizing sexual conduct between a teacher and a student (who is younger than 21) violated the Arkansas Constitution. The appellate court distinguished the Arkansas law on the basis that it ?did not specifically state that the teacher?s behavior was criminal because he or she is in a position of trust or authority.? The appellate court pointed out that ?in contrast to the Arkansas crime, our Kansas statute does recognize the aspect of authority.? The appellate court, therefore, found that there was a rational basis for the Kansas law.

Lastly, as to Edwards? argument that Idaho and Iowa courts have refused to find civil liability based on a teacher?s sexual relations with a student, the appellate court responded that that fact does not make Kansas? criminal statute unconstitutional. It noted that ?Edwards cites no support for the proposition that there can be no criminal liability where there is no corresponding civil liability.? In addition, the court pointed out that ?other courts have held a student does have an action against a teacher for an alleged violation of the Fourteenth Amendment ? as a basis for a 42 U.S.C. ? 1983 claim ? when there was a consensual sexual relationship between the student and teacher.?

Sen. Lindsey Graham Rejects Susan Rice's Self-Defense

Sen. Lindsey Graham, R-S.C., said today he does not believe that U.S. Ambassador to the United Nations Susan Rice relied on the most accurate information from the intelligence community when she provided a public explanation for the attack on the U.S. consulate in Benghazi, Libya.

"I'm increasingly convinced that the best and current intelligence assessment on 16 September went against the video. The video was a political smokescreen," Graham said on "This Week With George Stephanopoulos." "The actual facts were this was a coordinated, pre-planned terrorist attack."

Speaking at the United Nations on Wednesday, Rice said that some of the attacks leveled against her by Republican lawmakers were "unfounded."

"When discussing the attacks against our facilities in Benghazi, I relied solely and squarely on the information provided to me by the intelligence community. I made clear that the information was preliminary and that our investigations would give us the definitive answers," Rice said.

Graham rejected that explanation again today.

"My belief is that there was a mountain of intel to dispute the video characterization," Graham said on today. "There was really no intel saying this was a spontaneous event."

Asked whether he would oppose Rice's potential nomination as Secretary of State, Graham would not repeat his past assertions that she should be disqualified for the post if President Obama chooses to nominate her.

"When she comes over, if she does, there will be a lot of questions asked of her about this event and others," Graham said. "But I do not believe the video is the cause ? I don't believe it was ever the reason for this. That was a political story, not an intel story, and we're going to hold people accountable."

Earlier this month, Graham had said that because of the explanation Rice gave for the Benghazi attack, he was "dead set" on making sure Rice isn't "promoted."

On Sunday he added that he would pursue an investigation into Benghazi "like we got to the bottom of Iran-Contra," referring to the 1980s scandal when the Reagan administration made a secret deal with Iran to sell them weapons in exchange for the release of American hostages held in Lebanon, and some of the money from the sale was diverted to support the Contra rebels fighting the Sandinista government in Nicaragua.

"We're not going to let up on this," he said.

Democratic Sen. Dick Durbin insisted that Republicans are unfairly focusing on Rice's statements after the attack.

"If this were an NFL game, the critics of Ambassador Rice would be penalized for piling on," Durbin said. "For goodness sake, she got the report from the intelligence community; she dutifully reported it to the public, just exactly what we expect her to do.

"They had decided not to include the al Qaeda references so we wouldn't compromise our sources in Benghazi and in Libya," he said.

HAGERSTOWN, Md. (AP) ? An Army private charged in the biggest security breach in U.S. history is trying to avoid trial by claiming he's already been punished by confinement conditions that a United Nations torture investigator called cruel, inhuman and degrading.

Pfc. Bradley Manning is expected to testify about his treatment during a pretrial hearing starting Tuesday at Fort Meade. The young intelligence analyst has never spoken publicly about his nearly nine months in the Marine Corps brig in Quantico, Va., from July 2010 to April 2011. The hearing is scheduled to run through Sunday.

Manning was confined alone in a 6-by-8-foot cell for at least 23 hours a day, according to documents filed by the defense. For several days in January 2011, all his clothes were taken from him each night until he was issued a suicide-prevention smock, military officials have said.

The Defense Department has said Manning's treatment properly conformed to his classification as a maximum-custody detainee who posed a risk of injury to himself or others. He was moved in April 2011 to Fort Leavenworth, Kan., where he has a medium-security classification.

Publicity about Manning's treatment helped bring worldwide attention to his case. In March, UN Special Rapporteur on Torture Juan E. Mendez presented a report to the UN's Human Rights Council in which he criticized the U.S. government for refusing his repeated requests for a private visit with Manning.

Although they never spoke, "I am persuaded that Pfc. Manning was subjected to cruel, inhuman and degrading treatment" in violation of the UN Convention Against Torture, Mendez wrote in a Nov. 15 email to The Associated Press.

Mendez said he doesn't know if Manning's treatment amounted to torture, as Manning supporters claim.

Military judges can dismiss all charges if pretrial punishment is particularly egregious, but that rarely happens. The usual remedy is credit at sentencing for time served, said Lisa M. Windsor, a retired Army colonel and former Army judge advocate now in private practice in Washington.

"I think the likelihood of him getting any charges dropped is extremely remote," she said.

If the military judge refuses to dismiss the case, defense attorney David Coombs has requested 10-for-1 credit for 258 days of supposedly punitive confinement. That would knock a little more than seven years off Manning's sentence if he is convicted. He faces the possibility of life imprisonment if convicted of the most serious charge, aiding the enemy, and 162 years on the 21 other counts. His trial is set to begin Feb. 4.

Jeff Paterson, a leader of the Bradley Manning Support Network, said the credit would be meaningless if Manning gets a lengthy sentence.

"If that credit is meaningless, then that signals that you can actually torture any personnel or detainee without any actual consequences," Paterson said.

Manning is accused of sending to the secret-spilling website WikiLeaks hundreds of thousands of classified Iraq and Afghanistan war logs and more than 250,000 diplomatic cables while working as an intelligence analyst in Baghdad in 2009 and 2010.

The 24-year-old native of Crescent, Okla., allegedly told a confidant-turned-informant in an online chat in 2010 that he leaked the information because "I want people to see the truth."

Manning has offered to take responsibility for the leak by pleading guilty to reduced charges. The military judge hasn't yet ruled on the offer. It is not part of a plea deal, and it would not preclude prosecutors from pursuing the original charges.

Egypt's political foes dig in their heels

CAIRO (AP) ? Supporters and opponents of Egypt's president on Sunday grew more entrenched in their potentially destabilizing battle over the Islamist leader's move to assume near absolute powers, with neither side appearing willing to back down as the stock market plunged amid the fresh turmoil.

The standoff poses one of the hardest tests for the nation's liberal and secular opposition since Hosni Mubarak's ouster nearly two years ago. Failure to sustain protests and eventually force Mohammed Morsi to loosen control could consign it to long-term irrelevance.

Clashes between the two sides spilled onto the streets for a third day since the president issued edicts that make him immune to oversight of any kind, including that of the courts.

A teenager was killed and at least 40 people were wounded when a group of anti-Morsi protesters tried to storm the local offices of the political arm of the president's Muslim Brotherhood in the Nile Delta city of Damanhoor, according to security officials.

It was the first reported death from the street battles that erupted across much of the nation on Friday, the day after Morsi's decrees were announced. The officials, who spoke on condition of anonymity because they were not authorized to speak to the media, identified the boy as 15-year-old Islam Hamdi Abdel-Maqsood.

The tensions also dealt a fresh blow to the economy, which has suffered due to the problems plaguing the Arab world's most populous nation since Mubarak's ouster.

Egypt's benchmark EGX30 stock index dropped 9.59 percentage points Sunday in the first trading session since Morsi issued his decrees. The losses were among the biggest since the turbulent days and weeks immediately after Mubarak's ouster in a popular uprising last year. The loss in the value of shares was estimated at close to $5 billion.

The judiciary, the main target of the edicts, has pushed back, calling the decrees a power grab and an "assault" on the branch's independence. Judges and prosecutors stayed away from many courts in Cairo and other cities on Sunday.

But the nation's highest judicial body, the Supreme Judiciary Council, watered down its opposition to the decrees on Sunday. It told judges and prosecutors to return to work and announced that its members would meet with Morsi on Monday to try to persuade him to restrict immunity to major state decisions like declaring war or martial law or breaking diplomatic relations with foreign nations.

Morsi supporters insist that the measures were necessary to prevent the courts, which already dissolved the elected lower house of parliament, from further holding up moves to stability by disbanding the assembly writing the new constitution, as judges were considering doing. Both the parliament and the constitutional assembly are dominated by Islamists. Morsi accuses Mubarak loyalists in the judiciary of seeking to thwart the revolution's goals and barred the judiciary from disbanding the constitutional assembly or parliament's upper house.

Opposition activists, however, have been adamant since the crisis first erupted that they would not enter a dialogue with Morsi's regime before the decrees are rescinded.

Protesters also clashed with police at Cairo's Tahrir Square, the birthplace of the mass protests that toppled Mubarak, and in the side streets and avenues leading off the plaza. The Interior Ministry, which is in charge of the police, said 267 protesters have been arrested and 164 policemen injured since the unrest began a week ago, initially to mark the anniversary of street protests a year ago against the nation's then-military rulers. Forty-two protesters were killed in those demonstrations.

The ministry did not say how many protesters were injured in the latest clashes in Tahrir, but security officials put the figure at 260.

Hundreds of protesters staging a sit-in in Tahrir have vowed not to leave before Morsi rescinds his decrees. The two sides also have called for massive rival protests Tuesday in Cairo, signaling a protracted struggle.

Morsi's office issued an English-language statement late Sunday defending his decrees and repeating the argument he used when addressing supporters Friday outside his Cairo palace ? that they were designed to bolster the country's transition to democratic rule and dismantle Mubarak's old regime.

"The presidency reiterates the temporary nature of the said measures, which are not meant to concentrate powers," it said. The statement also pledged Morsi's commitment to engaging all political forces on the drafting of a new constitution. Secular and Christian members withdrew from the panel drafting the document, alleging that the Islamists who dominate the body have hijacked the process to produce a charter with an Islamist slant.

Nader Omran, of the Brotherhood's Freedom and Justice party, said any changes to the decrees were "out of the question" but Morsi might "make pledges, vows or addendums explaining his position to clarify the decrees."

He said Morsi would hand over his legislative powers to parliament's upper chamber once a new constitution is adopted in a nationwide referendum and ahead of parliamentary elections. The presidency did not confirm the claim, but doing so would leave the Egyptian leader with the state's executive and legislative powers until around April.

The move also has caused some internal discord among the Morsi camp, with one aide, Samer Marqous, already resigning to protest the "undemocratic" decree.

Another Morsi adviser Ayman al-Sayyad wrote on his Twitter account that the president met Sunday for the second time in as many days with his 17-member advisory council and three of his assistants.

"I think it (the meeting) produced a genuine realization of the gravity of the situation ... We were candid today in our meeting with the president and we now expect practical steps on the ground." He did not elaborate.

Leading Egyptian democracy advocate Mohammed ElBaradei, a Nobel Peace Laureate and a former director of the U.S. nuclear agency, warned Saturday of increasing turmoil that could potentially lead to the military stepping in unless Morsi rescinds his new powers.

Egypt's liberal and secular groups ? long divided, weakened and uncertain as Islamist parties rose to power in the months after the revolution ? are seeking to rally in response to the decrees as the stakes are high. The fractured opposition came together as the engine of the 18-day uprising that forced Mubarak to step down after 29 years in power, bringing millions out on the streets, but they have failed to recapture that energy after months of setbacks.

Morsi, meanwhile, already has backed down twice in high-profile battles with the judiciary in the five months he's been in office. The U.S.-trained engineer failed to challenge the court ruling dissolving parliament's powerful lower chamber and had to rescind his decision to fire the country's attorney-general, Mubarak-era appointee Abdel-Maguid Mahmoud, in October. He fired him on Thursday as part of his edicts.

(AP) ? Gravy was still warm. Dallas Cowboys were still in uniform. Thanks were still being given across the country as the pilgrimages to the stores began, heralding a new era of American consumerism.

Lured by earlier-than-ever Black Friday sales, people left Grandma and Grandpa in search of Samsung and Toshiba. They did not go blindly: In dozens of interviews, people acknowledged how spending has become inseparable from the holidays. Older folks pined for the days of Erector Sets and Thumbelinas while in line to pay iPad prices. Even some younger shoppers said it felt wrong to be spending money instead of quality time on Thanksgiving.

"But we're still out here," said Kelly Jackson, a paralegal who was standing inside a Best Buy store in the Pittsburgh suburbs, a 32-inch television ($189) in her cart. It was a consolation prize: Despite four hours on line, she missed the cheaper 40-inchers ($179) that she had heard about while listening to Internet radio.

Jackson's resignation was common among those who flocked to capitalism's temples for the consumer equivalent of genuflecting. Many said that this Black Friday bled into Thursday crossed a line, that merchants should not intrude like this. Christmas is about the message of Jesus, the feeling went ? not about the gold, frankincense and myrrh.

Yet amid these protests, people still talked about feeling powerless beneath the moment ? as if they had no choice but to shop.

"You have to have these things to enjoy your children and your family," said Jackson's friend Ebony Jones, who had secured two laptops ($187.99 each) for her 7 and 11 year olds.

Why must we buy? To demonstrate our love for others? To add a few more inches to our televisions? To help America recover from a vicious recession that itself was born of the desire for more?

Such questions make Jones wince. "It shouldn't be that way, but in a sense there's no way around it," said Jones, a nurse. "Everything ends up with a dollar amount. Even your happiness."

Retailers have long capitalized on the holiday season's perfect storm of emotion and tradition. "We all want to be loved, we all like to give love," says Roger Beahme, director of the Center for Retail Innovation at the Wake Forest Schools of Business. Through a flood of advertising on TV, radio and newspapers, he says, retailers can create emotions.

"Will Rogers said it's the art of convincing people to spend money they don't have on something they don't need," Beahme says. Although advertising can serve useful purposes, he says, "there's some truth to that."

Many embrace the feeling ? and have, in accelerating ways, for a generation and more. Without legions of believers, Black Friday never would have gotten this bold. "It's all part of the holiday ? part of the tradition," said Dennis River, a truck driver who was in line for a television at the Walmart in Beaver Falls, a small community outside of Pittsburgh. Last year, he went out alone at midnight Thursday. This year, he brought his wife and daughter. They were in place by 7 p.m.

"You get up in the morning, cook, do your dinner and your football, then you go shopping," River said. "It's the new thing now. Everyone's afraid of change."

"If they wanna have sales today," he said, "I'm gonna go shopping today."

Walmart's cavernous store is always open, but the deals began at 8 p.m. As with most big retail stores, a police car was parked near the Beaver Falls store entrance. A uniformed officer was at the door, near a stand holding maps to "featured products" such as bikes, cookware, sheets, video game consoles, and eight different TVs.

The witching hour approached. Yellow CAUTION tape cordoned off the bargains and funneled a few thousand supplicants through aisles of ignored items ? yarn, shower curtains, party hats, clocks. Balloons printed with dollar signs followed by low numbers floated above the treasures.

As the cell phones struck eight, a din arose. Excited voices mixed with the sound of boxes dropping into metal shopping carts. The balloons danced as people dug into stacks of leather ottomans ($29) and 5-by-5 foot bins of $5 DVDs.

The temperature climbed. An old man inched through the throng using a folding chair ($11.88) as a crutch. Traffic jammed. Complaints and a few curses echoed.

"I'm not an angry person, but I was angry for the 20 minutes I was in there," Danyel Coyne, a college student, said as she loaded a child booster seat ($12.98) into her trunk.

She and her boyfriend, Mike Yanke, had not come to shop. They needed a spare car seat to take Yanke's daughter back to Pittsburgh. Yet Yanke still had bought a red, battery-powered convertible ($129) at his dad's request.

"I wouldn't say Black Friday has taken over," said Dave Davies, a music producer who was part of the national parade of TVs (his was 50 inches and $399). "Shopping IS the holiday. That's all people care about ? what are you gonna get?"

For some, the items themselves can even take a back seat to the simple act of shopping.

Childhood friends Jesse Bredholt, Ryan Seech and a few other buddies have camped out at Best Buy for four years straight. This year, they arrived a full week early, with a tent, sleeping bags, deodorizing mist sprayer, propane heater and battery power for their gadgets.

They had no idea what they would buy. That was not the point.

For this group of single men in their early 20s, part of a generation who mark the passage of time by their first cell phones and video games, the point is spending time with each other at the source of the products that have always defined their lives.

"Our family is here," said Bredholt, who works for a health-care company. "With five guys on one mattress, you gotta be family."

Karen Jefferson, 49, also has found family on line at Best Buy, beyond her husband and three children. She was there Wednesday, seated on a folding chair, clutching a rolled-up circular.

"I'm missing Thanksgiving, and my husband thinks I'm crazy," said Jefferson, who works at a mortgage insurance company. "But I do this every year . because I enjoy meeting people and the people that come when I do. I mean, you see the same people year after year. And I do get some very good deals."

What about studies that have shown better deals are available at other times of the year?

"Oh, really?" Jefferson said. "You just think, Black Friday! Oh, my gosh, that's the deal of the year."

"Maybe that's something I need to look into," she continued. "Because, I mean, if these aren't good deals, then what are we DOING then?"
